Two judges now face possible removal from office after former LSK president Nelson Havi lodged a scathing complaint accusing them of gross misconduct and incompetence. The accusations have triggered debate in legal circles, with eyes now fixed on the Judicial Service Commission.
In a petition dated July 15, 2025, Havi targeted Lady Justice Josephine Mongare over her handling of a commercial dispute involving Gikomba Business Centre Limited and the Pumwani Riyadha Mosque Committee. He claimed her conduct between April and June this year was biased, unjust, and a direct threat to the rule of law. “She acted in a manner that offends justice. The only appropriate recourse is her removal,” Havi said under oath.
The second complaint involves Justice Prof Dr Nixon Sifuna, whom Havi accused of disorderly courtroom conduct while presiding over a case between an insurance firm and the Consumer Federation of Kenya. The case, heard from June 4 to July 16, allegedly saw the judge shift blame onto Havi after questions were raised about his handling of proceedings.
“It is improper for a judge to behave erratically and deflect scrutiny,” Havi maintained.
The Judicial Service Commission has yet to issue a formal response, but if the petitions are upheld, a tribunal may be formed to investigate both judges. According to insiders, the Commission is expected to review the evidence this week.
This development comes as pressure builds on the judiciary to clean house amid rising public demand for transparency and accountability in courtrooms. While some legal experts applaud Havi’s boldness, others question the timing and implications of his move.
Whether the JSC will act decisively or quietly shelve the matter remains uncertain. For now, the fate of the two judges hangs in the balance.
